Terms of Service

These Terms govern your use of Dakaar POS and the services at dakaarpos.com. By creating an account or activating a license you agree to be bound by them.
1. Definitions
- Operator — Avatar Technologies, GSTIN 29ENGPK5667E4ZI, registered office at F7, Savitri Arcade, Konekarwada, Karwar - 581301, Karnataka, India.
- Service — the Dakaar POS Windows application together with the website at
dakaarpos.com. - Customer / You — the natural person or entity who has agreed to these Terms.
- License — a single-PC, time-limited authorisation to use the Service issued against a paid subscription.
2. Free trial
Every new account begins on a 7-day free trial of the full Service. No payment information is required to start the trial. At the end of the trial the Service reverts to read-only access until a license is activated.
3. License grant
Subject to ongoing payment, the Operator grants you a non-exclusive, non-transferable, non-sublicensable right to install and use one copy of the Service on one PC per license. You may move a license between PCs using the in-product reinstall flow, which validates an OTP sent to your registered email. Each successful reinstall retires the previous key.
4. What you may not do
- Reverse engineer, decompile or disassemble the Service except to the extent permitted by law.
- Resell, sublicense, lease or distribute the Service or your license key.
- Run the Service on more than one PC simultaneously per license.
- Use the Service to violate Indian law, defraud customers, evade taxes, or assist any unlawful activity.
- Tamper with audit records, license signatures or built-in restrictions.
5. Subscription, fees, and renewal
The Service is billed annually in advance per the prices published on the pricing page. Pricing is exclusive of GST; the final invoice includes GST as applicable. Renewal payments stack onto remaining time — paid days never expire mid-cycle.
If a renewal payment is not received by the expiry date, the Service reverts to read-only mode until a payment is completed. Past data remains accessible. Renewal at any time reactivates the Service.
6. Refunds
Refunds are governed by our separate Refund Policy. In short: the trial covers all evaluation; once a year is paid, refunds are issued only for proven duplicate payments or charges made in error.
7. Customer responsibilities
- Backing up the local SQLite database. The Operator does not store a copy of your operational data.
- Keeping account credentials and license keys confidential.
- Using the Service in compliance with the GST Act, the Consumer Protection Act, and any sector-specific regulations applicable to your restaurant.
- Maintaining the underlying hardware, operating system, printers and internet connection.
8. Service availability
The Service is offline-first; the website portal at dakaarpos.com is delivered on a best-effort basis without an explicit SLA. Scheduled maintenance is announced where possible. The Operator is not liable for downtime caused by Razorpay, Hostinger, your internet service provider, or any force majeure event.
9. Updates
The Operator may release updates that fix bugs, improve security, or add features. Updates are included for the duration of an active subscription at no additional cost. The Operator may change features, refactor APIs or deprecate behaviour with reasonable notice through release notes or email.
10. Intellectual property
All copyrights, trademarks, source code and design assets in the Service remain the property of the Operator. The license granted under these Terms does not transfer ownership of any intellectual property.
11. Disclaimer of warranties
The Service is provided "as is" without warranties of merchantability, fitness for a particular purpose, or non-infringement, except those that cannot be disclaimed under Indian law. The Operator makes no representation that the Service will meet every operational need or be free of defects.
12. Limitation of liability
To the maximum extent permitted by law, the Operator's aggregate liability for any claim arising out of or related to these Terms is limited to the amount paid by the Customer in the twelve months immediately preceding the claim. The Operator is not liable for indirect, incidental, consequential, or punitive damages, including lost profits or data loss.
13. Indemnity
You agree to indemnify the Operator against any claim arising from your use of the Service in violation of law, these Terms, or third-party rights.
14. Termination
Either party may terminate by written notice. The Operator may suspend or terminate accounts that breach these Terms, issue chargebacks, attempt unauthorised access, or remain delinquent on renewal beyond 60 days. On termination you may export your operational data; payment records are retained as required by tax law.
15. Governing law and jurisdiction
These Terms are governed by the laws of India. The courts at Karnataka have exclusive jurisdiction over any dispute, subject to the parties' attempt at amicable resolution through the Grievance Officer first.
16. Changes to these Terms
The Operator may update these Terms. Material changes will be announced by email and posted on this page at least 14 days before they take effect. Continued use of the Service after that constitutes acceptance.
